Executive Order #23
TO:HEADS OF ALL STATE DEPARTMENTS AND AGENCIES
RE:Amending executive order number eighteen to authorize updates to the Delaware permitting accelerator and to require its publication.
WHEREAS, Executive Order Number Eighteen, signed February 26, 2026, implemented the Delaware Permitting Accelerator to streamline and coordinate the State’s permitting processes
for priority housing, energy, broadband, water, and sewer infrastructure projects; and
WHEREAS, the Delaware Permitting Accelerator contains detailed procedural and operational provisions that, in the ordinary course of implementation, may require periodic updates to reflect changed circumstances, agency experience, federal program requirements, or evolving best practices; and
WHEREAS, requiring a full Executive Order for each such operational update creates unnecessary delay and administrative burden without commensurate public benefit; and
WHEREAS, it is consistent with sound public administration to make appropriate updates to the Delaware Permitting Accelerator, subject to the Governor’s express written approval, public transparency, and the safeguards set forth herein.
NOW, THEREFORE, I, MATTHEW MEYER by virtue of the authority vested in me as Governor of the State of Delaware, do hereby DECLARE and ORDER that:
- Authorization to Update the Delaware Permitting Accelerator. The Office of the Governor is hereby authorized to issue updated versions of the Delaware Permitting Accelerator attached to Executive Order Number Eighteen, subject to the Governor’s
written approval and in consultation with all agencies affected by the modification. - Public Posting. Upon the Governor’s written approval of any update, the Office of the Governor shall promptly post the current version of the Delaware Permitting Accelerator on the State’s website, identified by version number and effective date.
- Relationship to Executive Order Number Eighteen. This Order supplements and partially amends Executive Order Number Eighteen. All provisions of Executive Order Number Eighteen not expressly modified herein remain in full force and effect. To the
extent any provision of this Order conflicts with Executive Order Number Eighteen, this Order shall govern with respect to the amendment procedure established herein. - No Rights Created. The Delaware Permitting Accelerator is intended only to improve the internal management of the Executive Branch and may not be construed to create any right or benefit, substantive or procedural, enforceable at law or in equity, by any
party against the State of Delaware, its agencies, officers, employees, or any other person. The Delaware Permitting Accelerator may not be construed to limit my authority to issue, amend, or rescind executive orders, or to otherwise direct the
operations of the Executive Branch. - Effective Date. This Order is effective immediately upon signature and remains in effect unless amended or rescinded by subsequent executive order. Any project that has been accepted for accelerated permitting that satisfies the eligibility standards in the version of the Delaware Permitting Accelerator promulgated on this date is hereby deemed eligible for such acceptance or designation as of the date of its original acceptance or designation.
