EXTENSION OF THE DECLARATION OF A STATE OF EMERGENCY
FOR THE STATE OF DELAWARE
DUE TO A PUBLIC HEALTH THREAT

WHEREAS, in connection with the continuing public health threat from the novel coronavirus (“COVID-19”) and its highly transmissible variants such as Delta and Omicron, I issued a Declaration of a State of Emergency for the entire state at 11:30 a.m. on January 3, 2022, enabling members of the Delaware National Guard to work as Certified Nursing Assistants (CNAs) in skilled nursing facilities, increasing bed capacity in acute care facilities, and allowing the Public Health Authority to suspend deadlines and timetables for licensure activities and certain other regulatory requirements in Title 16 in order to combat the surge in cases; and

WHEREAS, on January 10, 2022, I issued the First Revision to the Declaration of a State of Emergency Due to a Public Health Threat, requiring Delawareans to wear masks in indoor public settings and easing State regulations to allow recently retired educators to return to the classroom as substitute teachers in an effort to keep children in school; and

WHEREAS, on January 14, 2022, I issued the Second Revision to the Declaration of a State of Emergency Due to a Public Health Threat, allowing DPH to approve alternative mitigation measures in place of the mask mandate for professional and NCAA athletes; and

WHEREAS, on January 31, 2022, I issued the Third Revision to the Declaration of a State of Emergency Due to a Public Health Threat, authorizing the Secretary of DelDOT to issue waivers of state enforcement of laws and regulations applicable to commercial vehicles operating in support of a declared emergency; and

WHEREAS, the State of Delaware continues to face a serious public health threat from COVID-19 and the harm to life remains significant; and

WHEREAS, pursuant to Delaware’s emergency management statutes, a State of Emergency proclaimed by the Governor may not continue for more than 30 days without being renewed; and

WHEREAS, I find that the conditions necessitating a State of Emergency continue to exist and require that the State of Emergency remain in effect.

NOW THEREFORE, I, JOHN C. CARNEY, hereby declare:

1. The State of Emergency due to COVID-19, first declared January 3, 2022 and subsequently revised as set forth above is extended, effective immediately.
2. All provisions of the State of Emergency and its two revisions currently in place shall remain in full force and effect until terminated in accordance with state law.
