Executive Order 55

EXECUTIVE ORDER

NUMBER FIFTY-FIVE

TO:     HEADS OF ALL STATE DEPARTMENTS AND AGENCIES

RE:     NATIONAL GUARD SUPPORT FOR THE STOCKLEY CENTER

WHEREAS, the Stockley Center, located in Southern Delaware, is a 50-bed Medicaid-certified Intermediate Care Facility for individuals with Intellectual and Developmental disabilities that provides both intermediate and skilled nursing care for individuals requiring a variety of complex supports and medical needs; and

WHEREAS, each residential suite at the Stockley Center is staffed by registered nurses and certified nursing assistants among other ancillary staff members assisting residents to meet their physical, mental, personal and social needs; and

WHEREAS, due to a recent increase in COVID-19 community levels, industry-wide staffing shortages, and staff call-outs, the Stockley Center is facing staffing shortages; and

WHEREAS, given the vulnerability of the population served at the Stockley Center, activation of the Delaware National Guard is appropriate to provide Delaware National Guard members who are certified nursing assistants, registered nurses, or other healthcare providers, as permitted under state law and orders, to support the Stockley Center; and

WHEREAS, pursuant to Title 20, Chapter 1, Section 171 of the Delaware Code, in the best interest of the State, the Governor may call out units or members of the Delaware National Guard to serve on state duty status to respond to any emergency situation.

NOW, THEREFORE, I, JOHN C. CARNEY, pursuant to Title 20, Chapter 31 of the Delaware Code, do hereby direct and authorize:

  1. The Delaware National Guard is hereby activated to State Active Duty to provide Delaware National Guard members who are certified nursing assistants, registered nurses, or other healthcare providers, as permitted under state law and orders, to support the Stockley Center.
  2. The Delaware National Guard is also authorized to provide Delaware National Guard members who are certified nursing assistants, registered nurses, or other healthcare providers, as permitted under state law and orders, in a manner similar to the assistance outlined for the Stockley Center above, to any other state entity, upon request.
  3. The Delaware National Guard shall take precautionary or responsive actions as directed by the Director of the Delaware Emergency Management Agency, in consultation with the Secretary of Safety and Homeland Security.
  4. This Executive Order shall take effect at 6:00 p.m. on May 22, 2022 and shall remain in effect until terminated in accordance with state law.
